  •   本研究著眼台灣太空發射活動之發展,欲探討台灣在實施太空發射活動時應遵循之國際太空發射責任規範。鑒於台灣目前太空發射責任規範密度不足,本研究藉由與台灣太空發射活動發展進程、規範體系或背景因素相當之亞太地區主權國家的內國太空發射規範比較整理,並結合國際太空發射責任之探討,歸納台灣未來在太空發射責任規範之立法建議。
      
      本研究首先釐清古典國際法下主權國家之國家責任內涵,再透過聯合國大會1961年第1721(XVI)及1963年第1962(XVIII)兩號決議內容勾勒國際太空法原則之輪廓,作為探討國際太空發射責任規範之背景概述。接續探討太空、太空物體、損害與發射損害等定義內涵,作為太空發射責任規範的解釋基礎,並將國際太空發射責任規範要件解構為責任主體、責任條件、責任歸屬、責任規範適用對象與期間逐一描繪。最後就國際太空發射責任之損害賠償與救濟規範說明。

      在各國太空發射責任規範比較研究方面,本文以日本、南韓、印尼及紐西蘭之國內太空發射規範作為比較研究之對象。以逐國探討方式,說明各國太空活動發展及內國規範體系現況、與發射相關之活動、授權管理機制、損害賠償與違法行為規範內涵。最後,整理歸納上述國家內國太空發射之管制、授權與監督、損害賠償及不法行為之罰則規範要素,作為未來台灣國內太空發射規範制定之參考。

      鑒於台灣主體之特殊性無法簽署或加入構成國際太空法源則之條約,故必須先確認現行國際太空發射規範中,被視為、或逐漸發展成為多數國家所承認並遵循之習慣國際法。透過條約施行法制定將其內國法後,再以此為基礎制定國內太空發射責任規範。考量台灣目前與太空發射相關之規範內容,在未來立法階段中,至少應確立太空發射管制機構、與發射相關之授權機制、太空活動之登記與監督方式及損害責任賠償等。


    Considering the development of launching activities in Taiwan, this research finds out international launching liability which must be complied with when implementing space launching activities in Taiwan. In the view of lacking launching liability in Taiwan, this research compares and organizes few asia-pacific sovereign States’ national space law which are similar to the development of launching activities, the legal system or the background factors in Taiwan. After combining the result mentioned above with international launching liability, this research concludes the legislative advice of launching liability for Taiwan in the future.
      
    The research first clarifies the content of State responsibility under international law, and depicts corpus iuris spatialis with United Nations General Assembly Resolution No. 1721(XVI) (1961) and No. 1962(XVIII) (1963) as a background for discussing international launching liability. In order to interpret the content of international launching liability, the research first gives clear definitions of space, space object, damage and launching damage etc. then discusses the liability subjects, conditions of liability, accountability, object of the application of liability and the duration of liability one by one. Finally, the research illustrates damages and remedies of international launching liability.

    With regard to launching liability of national space law, the research chooses Japan, Republic of Korea, Indonesia and New Zealand as targets for comparison. The research concludes the legislative advice of launching liability of national space law for Taiwan in the future through studying and organizing the development of space activities, the status of national legal system, activities related to launching, mechanisms of authorizations and management, damages and wrongful acts State by State. To sum up, considering the status of legal system related to launching in Taiwan, this research suggests that Taiwan must at least establish these regulations which includes the institution for launching control, the mechanism related to launching authorizations, the registration and supervision of space activities and liability for damages in the future.
