歐盟電業自由化自1996年電力市場指令要求各成員國開放電力市場競爭發展至今，已完成各成員國間共同電力市場整合，並極力發展再生能源。歐盟競爭主管機關為確保共同電力市場內競爭秩序，並協助能源管制機關維護電力市場規範穩定運行，依據歐盟競爭法對於限制競爭操作執法甚嚴，同時利用競爭法作為促進共同電力市場轉型、發展的工具。對比我國電業法2017年修訂後僅開放再生能源電力市場競爭，目標在2025年達成20%再生能源占比。我國從歐盟電業自由化中調和能源轉型以及電力市場競爭兩個目標的過程中，競爭法所扮演的角色為何？對比我國目前能源轉型規劃以及再生能源市場的開放，有什麼值得借鏡的優點以及應該避免的錯誤？
　　本文從競爭法下限制競爭議題作為探討主軸。觀察歐盟逐步開放電力市場競爭後，歐盟競爭主管機關依據歐盟競爭法所做成之限制競爭處分案例，包含禁止具優勢地位之電業濫用市場獨占力；電業間做成限制競爭協議；以及電業間為結合是否會產生限制競爭疑慮。
　　本文挑選歐盟競爭主管機關做成的電力市場限制競爭以及結合管制的代表性案例，分析歐盟電業如何為限制競爭之操作，違反市場公平競爭秩序，並以之為基礎，分析我國電業法規劃分兩階段開放電力市場競爭後，是否有出現類似的限制競爭操作之誘因？尤其是針對我國自2017年電業法修定後，發展中的「綠電先行」的再生能源市場，是否有出現類似限制競爭操作之疑慮。此時，若我國公平交易委員會欲介入管制，應如何適用公平交易法以確保我國電力市場之競爭秩序？

Since the First Energy Legislative Package, 1996 EU requires member states to open up the free competition in electricity market. In the following years, EU has completed the integration of the common electricity market among member states and has made great success in renewable energy development, with the goal of reaching 32% of renewable energy by 2030. Comparing to Taiwan's Electricity Act had passed the amendment in 2017 only open competition for renewable energy market, and set the goal of reaching 25% renewable energy ratio by 2025. How EU adjusts the energy transformation and free competition in electricity market liberalization? Compared to Taiwan's energy transformation and electricity liberalization goal, what can Taiwan learn from EU’s experience?
This thesis mainly focus on the role of competition law in the process of electricity market liberalization. Observing how EU competition law adopted in common electricity market abuse, cartel or merger cases by EU Commission.
This thesis selects the representative cases made by the EU Commission, analyzes how the electricity industry restricts competition, violates the EU competition law, and analyzes whether there’re possibilities that there may be similar scenarios occurs in Taiwan’s electricity market, after Taiwan open free market competition for electricity? Also, is there any chances that similar operations may occur in the Taiwan’s renewable market since Taiwan had just adopted the "Renewable Energy First" policy in 2017. How Taiwan’s Fair Trade Commission adapt the transformation of electricity market liberalization, is the purpose of this study.
