根據行政院統計，我國未成年少女的生育率約為千分之3至千分之4，意味著每年約有2000至3000名未成年少女生育，而實際懷孕之未成年少女數量更是只多不少，然《優生保健法》規定未成年少女須經父母同意，方可進行人工流產，對於面臨家庭暴力、性虐待等特殊情境的少女而言，此規範猶如一道難以跨越的高牆。2022年4月衛生福利部國民健康署公告《優生保健法修正草案》，將《優生保健法》改名為《生育保健法》，新增未成年少女人工流產得免除父母同意之規定，類似美國司法繞道程序。
然而，此款修正依舊否定未成年少女的生育自主權，且從司法繞道行之有年的美國，即可發現此種制度並非完美。因此本文將研究美國未成年人工流產的相關法規，並聚焦於司法繞道程序制度的運作與優缺點，希望透過參考美國制度實施的情況，做為我國制度的參考，更透過未成年生育自主權的建構，探討在資訊日益豐富的現代社會，是否應賦予未成年少女自主決定人工流產的權利。希望本研究能為我國相關立法提供參考，促進未成年少女生育自主權利的保障。

According to statistics from the Executive Yuan, the birth rate among minors in Taiwan is approximately 3 to 4 per 1,000, meaning that around 2,000 to 3,000 minors give birth each year. The actual number of pregnancies among minors is likely even higher. However, under the current Genetic Health Act, minors must obtain parental consent before abortion. For those facing family violence, sexual abuse, or other exceptional circumstances, this requirement creates an insurmountable barrier. In April 2022, the Ministry of Health and Welfare’s Health Promotion Administration announced a draft amendment to the Genetic Health Act, renaming it the Reproductive Health Act and introducing a provision allowing minors to abort without parental consent. This provision was likely inspired by the judicial bypass procedure in the United States.
Nonetheless, the proposed amendment still fails to fully recognize the reproductive autonomy of minors. Moreover, long-standing practices in the United States reveal flaws in the judicial bypass system. This study examines U.S. abortion laws pertaining to minors, with a focus on the operation, advantages, and disadvantages of the judicial bypass system. By analyzing the implementation of judicial bypass system in the United States, this study seeks to provide insights for improving Taiwan’s legislation. Furthermore, it explores the construction of reproductive autonomy for minors, addressing whether they should be granted the right to independently decide on abortion in an era of increasingly accessible information. It is hoped that this research will serve as a valuable reference for legislative development in Taiwan and contribute to safeguarding the reproductive autonomy of minors.
