伴隨數位匯流時代來臨，無論是網路聯結生活的智慧聯網崛起，抑或行動網路以及可攜式智能裝置普及等因素，在在皆促進了新興影音媒體OTT TV之茁壯，同時也逐漸改變了消費者的收視習慣。然而，新興崛起的OTT TV，在現況下幾乎並無受到相關法律之規範，相對於此，與其具有競爭關係的既有影音媒體卻受到重重法律管制，就此管制不一致之現象，是否有增進不公平競爭甚或是違反平等原則等爭議，已然成為通訊傳播產業與學術界之密切關注對象。

有鑑於此，本研究即欲從憲法平等原則作為切入點，嘗試去分析OTT TV與其他競爭影音媒體間究竟是否為相同事物而須受到相同管制。經本研究自各媒體特性與系爭特性所聯結之管制必要性一併比較分析後，認為 OTT TV與其他媒體處於「部分相同而部分相異」之特殊關係，因而在法律規制上其未受到完全相同之管制尚屬有理。

然而，即便在我國之法規範下，對OTT TV與其他媒體進行不一致之落差管制並未違反憲法原則，系爭差別對待仍需經過國際貿易法之檢驗。由於我國係世界貿易組織之會員國，應受到其關於服務貿易之規範限制，而服務貿易中即有要求會員國間對於同類服務應相同對待之不歧視原則，惟經本研究分析國際貿易實務之認定標準並涵攝於影音媒體後，認為OTT TV與其他媒體間應非屬同類服務而並未構成討論不歧視原則之前提問題。

最後，雖然在本研究的分析下，對於目前OTT TV之落差管制應得以同時通過我國憲法平等原則與國際經貿法上不歧視原則之檢驗，然則，考量到數位匯流下技術整合與演進速度極快，各該服務間究竟是否會被認定為同類以及有無受到相同管制之特性，實際上乃係一變動之事實而無固定不變之答案。因此，關於新興科技服務之管制議題，仍應持續關注與追蹤整體科技變化所帶來之影響，並且在法律規制上一併與時俱進。

The new audio-visual service OTT TV is changing consumers’ preference on choosing entertainment contents with approaching of the age of digital convergence. However, OTT TV is almost not subject to relevant laws and regulations. In contrast, other existing audio-visual services are subject to heavy regulations. Whether the regulation asymmetric between OTT TV and other audio-visual services might intensify unfair competition or violate the principle of equality has become popular legal issue.

This paper first analyze the similarity between OTT TV and other audio-visual services, discussing the necessity of identical regulation in view of the principle of equality in Constitution. After comparing characteristics of audio-visual services and regulation necessities attached to its characteristics, this paper find out that OTT TV and other audio-visual services consider to be “partially identical but partially different”. Therefore, the regulation asymmetric seems to be justified and not violating the principle of equality in Constitution.

Even though the regulation asymmetric does not violate Constitutional principle, it shall still be examined by international trade law. Taiwan is a member of the World Trade Organization, therefore it is necessary for us to comply with relevant regulation in trade of services. The General Agreement of Trade in Services requires members to treat like-services without discrimination. This paper find out that OTT TV and other audio-visual services are not like-services after analyzing the determination of international trade practices. Thus the regulation asymmetric may not constitute discrimination.

The regulation asymmetric in question seems to be justified under the principle of equality in Constitution and the principle of non-discrimination in international trade law. However, taking high-pace evolution in digital convergence into consideration, whether OTT TV and other audio-visual services are like-services and should subject to same regulation is still a question without definite answer. Therefore, it is necessary to continue tracking the impact of changes in the overall science technology and reform relevant regulation simultaneously.
