於科技發展日新月異的今日，網路相關之案件與日俱增，而網路代號作為自然人在網路社群中的代表，妨害網路代號名譽之案件亦屢見不鮮，然而由於其具備與真實身分隔絕、易於移轉拋棄甚至可能多人持有等特性，網路代號在法律上之定位至今未能明確，是否應以法律保障網路代號名譽更是司法實務上之爭議問題。

　　本文首先自網路空間及網路社群之特性出發，探討實體法律適用於網路世界可能面對之案件類型及問題，以及網路代號名譽案件之特殊性，並藉由分析各網路社群平台之運作方式及規範，了解網路社群使用者在相關案件中尋求司法救濟之必要性及目的。

　　在網路代號名譽案件之爭議上，本文聚焦於網路代號無法與真實身分產生連結之案件，以民國90年至108年間，案件事實為妨害網路代號名譽，且未指明使用者真實身分之民事侵權行為案件及刑事妨害名譽案件作為研究來源，試分析我國人民救濟途徑之選擇傾向及法院判決結果概況，並透過觀察歷年之實務案件判決理由，分別整理我國民事及刑事案件中，司法實務對於此類案件之考量因素及認定標準，並選擇詳細論述相關爭議之個案進行分析，做出整合探討，並提出本文之意見。

　　With the rapid development of technology today, the number of cases related to internet are increasing day by day, and cases which are concerning reputation rights of online identity also become common. However, with its characteristics included isolating from real identity, easily transferring and abandoning, and could be managed by multiple individuals, the legal position of online identity has not been clarified yet. Whether the reputation of online identity should be protected by law is a controversial issue in judicial practice.

　　This article starts from the characteristics of cyberspace and online community, discusses the difficulties about law application to the virtual world and the special features of online identity.

　　Regarding the issue of the reputation of the online identity, this article focuses on whether directed speeches at online identity are applicable to reputation law. Through observing the attitude and demonstration of judgments made from 2001 to 2019, this article tries to analyze and clarify the standard and development of cases concerning reputation rights of online identity of judicial practice in Taiwan.
