  • 隨著鑑識科學、數位資料庫、影像技術、社群媒體以及透過機器學習進行資料分析等科技發展,轉型正義脈絡下檔案的科技化為推動轉型正義進程、市民社會動員及民主鞏固帶來了新的可能性。在國際人權機構與各國轉型正義實踐中,愈來愈重視科技方法於轉型正義檔案的運用。本文旨在探討為何應在轉型正義脈絡中推動檔案科技化,並從規範框架與功能基礎層面論證其正當性。進一步地,本文亦分析不同轉型正義脈絡下的實踐經驗與異同,並以此為基礎,檢視台灣轉型正義檔案科技化的現況,提出適用於台灣脈絡下的法制與政策建議。

    本文主張,轉型正義檔案科技化的規範框架是植基在「真相權」與「科技近用權」的權利保障,並以此證成國家運用資源推動檔案科技化的正當性。本文認為,從功能角度,檔案科技化具有兩項重要作用:一是,科技應用可克服轉型正義進程在時間與空間上的限制,提升對過去人權侵害行為的調查效能;其次,科技化的檔案有助於轉型後國家的民主鞏固的成果。

    在國際實踐中,本文以西班牙、阿根廷、哥倫比亞等後威權國家,以及前南斯拉夫國際刑事法庭在後衝突脈絡下的經驗為研究對象,探討檔案科技化在不同情境中的功能。本文發現,在後威權脈絡下,轉型正義科技化的檔案填補了記憶的斷層,促進真相追尋與賠償效率;在後衝突脈絡下,檔案科技化則提升國際人權法庭的效能,強化在地人權倡議與國際司法之間的連結。

    基於以上分析,本文建議台灣應參考其他地區人權體系,從創建與恢復檔案、加強檔案永續管理、提升檔案的可及性與可參與性等方面,建立完整的檔案科技化法制框架。在政策實踐上,應採用地理資訊系統(GIS)、光學字元辨識(OCR)等技術,促進檔案的整合與傳播。同時,建議發展以鑑識科技為核心的政策與法律,針對威權時期加害體系的真相追尋提供具體指引與行動方向。


    Thanks to advances in forensic science, digital databases, digital media, social media, and analysis driven by machine learning, the application of archive technologies has opened new possibilities for transitional justice, civil society mobilization, and democratic consolidation. International human rights institutions and national initiatives are increasingly recognizing the importance of technological methods in managing these archives. This master’s thesis explores the need for the application of archive technologies and its normative and functional legitimacy. Using comparative experiences, it evaluates Taiwan’s current practices and proposes legal and policy recommendations.

    The normative framework for the application of archive technologies is rooted in the protection of the right to truth and the right to access to and participate in science, legitimizing state efforts and allocation of resources. Functionally, it serves two key roles: overcoming spatial and temporal challenges to transitional justice, enhancing investigation into human rights violations, and supporting democratic consolidation by improving the accessibility and usability of historical records.

    This master's thesis conducts a case study of post-authoritarian jurisdictions, including Spain, Argentina, and Colombia, alongside the post-conflict legal framework of the International Criminal Tribunal for the former Yugoslavia, to examine the role of archive technologies in transitional justice contexts. The findings of this thesis suggest that in post-authoritarian contexts, the application of archive technologies bridges gaps in memory, facilitates truth-seeking, and enhances reparations, while in post-conflict settings, it strengthens international tribunals and local human rights advocacy.

    From this analysis, Taiwan should adopt a comprehensive legal framework for the application of archive technologies, focusing on creation, restoration, sustainable management, and accessibility. Policy should prioritize geographic information systems, optical character recognition, and forensic methodologies to enhance archival integration and dissemination, advancing forensic-based truth-seeking in authoritarian-era perpetrator systems.
