本論文係由醫學倫理之基本議題，知情同意出發，試圖探討醫學倫理與法律實務之相關性。事實上倫理學是形而上學，而法學是實際的學問，二者間之相容或互斥，在在影響著專業醫事人員臨床執業上之行為。
醫學倫理的範圍，實在浩如煙海。如欲在一篇碩士論文中完全涵蓋，非不為也，實不能也。因此開始思考，何謂醫學倫理之根本，或是較為重要之議題。知情同意似乎是個不錯的題材，因為在民眾進入醫療行為之前，同意書的簽署是一項非常重要的步驟（手續）。絕大多數的治療都會牽涉到知情同意，再加上國內討論知情同意的論文並不多，較無題目重複之虞，因此就選定知情同意作為研究主軸。
知情同意極為重要，也是醫學倫理的重要議題之一，同時知情同意也已經被形諸於法律條文，成為醫事人員及醫療機構所必須遵守的法規。然則其他的醫學倫理議題呢？醫學倫理對醫事人員僅有宣示性的作用。醫學倫理與法律並非永遠相同或相容，二者還是可能會有所衝突或牴觸的。眾所週知，法律是倫理的最低標準，也是形於文字的標準。在遠古時代，科技並不發達，醫學倫理與法律並沒有太大的衝突；然而隨著時代及科技的進步，法律與倫理的衝突逐漸擴大。
本論文第一章介紹醫學倫理之內涵暨醫學倫理之基本理論，次由比較法學觀點介紹各國醫師會之倫理原則，續說明知情同意在醫學倫理中之地位，及知情同意之基本理論與內涵。本章最後一節則提出目前台灣推行醫學倫理之障礙。
第二章為醫學倫理與法律規範之衝突，第一節論述醫學倫理與法律實務之衝突類型。第二節敘述台灣目前醫學倫理之困境；第三節主要對醫療相關法律作評析，論述台灣法律對醫學倫理之規制，以及不合時宜之處。
第三章則針對知情同意與法律實務可能發生衝突的各個面向，作分節探討。各節佐以相關判決案例。判決案例之選擇兼採台灣本土案例及英美法之案例。
第四章進一步對台灣現行制度提出檢討，包括法律暨倫理規範，醫療團體的自律，及支援機制的設置等。
最末一章即為本論文之結論，將前四章檢討之所得綜合，嘗試說明現今醫學倫理不足之處，與法律規範之衝突點，對未來台灣醫學倫理及醫事相關法律之可能改進方向做一建言。
