由於無形資產已成為知識經濟的要角,智慧產權Intellectual Property Right (IPR)的重要性亦發受到廣大的重視。在自由競爭的基礎下,面對越來越激烈的商業競爭,企業必須投資更多於創新研發上以維持自己的優勢。而為了防止研發成果被盜用,使得企業遭受無法獲利、投資無法回收等損失,完善地管理研發成果變得十分重要。智慧產權也因此成為控管企業無形資產的重要工具。
近年來,專利侵權的官司時有所聞。無論是用專利作為商業攻擊的武器,亦或是作為防禦侵權的利器,專利對企業的重要程度與日俱增。然而,專利走向越來越趨策略性的運用後,其對提升競爭優勢的重要性,卻為中小企業帶來特別的挑戰。和趨勢相反地,畏於整個智財知識體系的高複雜性及高成本,受制於資訊不足和缺乏接觸的管道,且通常對自己發明的潛在價值和重要性認知不足,大多數中小企業未能廣泛且有效率地運用專利及智財知識。
本論文將深入研究一針對企業於智慧產權之資訊收集、分析以及專利策略性運用之協助的系統化方法及營運模式。透過模式建構及流程解析,以及比較現有智慧產權服務業者之服務以及專利運用之流程,從需求面上來分析、建立智慧產權服務的創新營運模式,期望對企業之掌握與應用專利能有所助益,提供更適合企業之專利應用運作模型。
Faced with an increasingly competitive marketplace in liberalized economies, companies must do investment in innovation to maintain their competitiveness. And they are faced with the need to find ways to manage their innovative results appropriately so as to avoid that their competitive edge is eroded by falling into the hands of the competition without being able to recoup their investments in R&D and making a reasonable profit. Intellectual property rights have emerged as a key tool for obtaining control over a company’s intangible assets. Regardless of using patent as a weapon of commerce attacks, or as a powerful tool in defense patent infringement, in recent years, the importance of patent for enterprises grows violent. The increasingly strategic uses of patents and their importance for competitive advantage, however, pose special challenges for small-medium sized enterprises (SMEs).
Nonetheless, it has been noted that enterprises are reluctant to use the IP system due to its perceived complexity, high costs, and low awareness of the IP impacts. Because of the information deficiency and underestimation of IP value, companies usually can not make widespread and effective utilization of the IP system. This study will concentrate on how to provide systematic approach to intelligent IP gathering, analysis, and IP knowledge services to enterprises. By model construction, process analysis, and analyzing the key functions of IP service providers, an innovative business model for intellectual property services is invented.
