氣候變遷所造成之全球暖化負面影響上，促使世界各國於相當程度上承認必須在「共同但有區別的責任」前提下，一起承擔改善環境之責任；因此發展對環境友善之低碳社會、促進經濟成長以及加速產業轉型，正係當前處理氣候問題之核心課題，至於如何從政府以及民間共同促進綠色能源科技的發展，即為其中關鍵之所在。
本文透過文獻分析以及比較法學等研究方法，探討於聯合國氣候變化綱要公約發展下，推動綠色能源科技技術移轉過程所面臨之近用落差問題，並擬借鏡以往在杜哈公共衛生宣言所解決之專利藥物近用問題，嘗試開拓解決綠色能源科技落差問題之新面向。
針對能源科技擴散所面臨的「近用落差之解決」以及「科技研發創新之促進」議題，本文提出公私部門合作模式作為解決方案，並透過美國所發展之相應科技創新法律制度進行比較，最後則與我國科技研究發展政策發展內容及問題予以檢討；並希藉由跨領域研究方式，回應氣候變遷下能源科技發展之新興倫理課題。

The impact of climate change has been urged most countries in the world to sign up the United Nations Framework Convention on Climate Change (UNFCCC), so as to fulfill the “common but differentiated responsibility”. In the context of climate change, how to develop an environmentally-friendly low carbon society and how to stimulate green technology innovation will be the key issues.
This thesis discusses the green technology access gap problem under UNFCCC and tries to figure out an effective way to encourage the cooperation between private sectors and the government. To this end, this thesis first makes a comparison between the green technology access gap and the medicine access gap, then introduces an innovative and feasible solution for the green technology access gap.
In the end, this thesis introduces two Public – Private Partnerships (PPP) models for accelerating technology research and develop in the United States; meanwhile, it reviews the issues discussed above then concludes with different suggestions. The findings unveiled in this thesis hopes to provide useful information for forming a feasible PPP system of green technology research and development between government and small businesses in Taiwan.
