自哥本哈根協議到德班加強行動平台，氣候變遷大會皆不斷強調公約中平衡(Balance)、透明(Transparent)、以及建構在共同擔容有差異(common but differentiated)原則下的自願減碳─NAMAs，此方案不僅根本性的改變了京都機制由上而下的已開發各國強制減緩，同時亦擴大了開發中國家的主動參與，引導已開發國家之資金、技術進入開發中以及低度開發國家。

然而，國際談判所建立的實體減緩行動，若無一個有效的程序保障實體之成果的有效性，根植於NAMAs所建立之額度市場機制也會遭到強烈的質疑，導致整個國際氣候變遷公約無法繼續發展。因此，坎昆會議後到德班大會期間的SB32和AW-LCA的工作小組會議，各國談判代表關注以可測量、可報告、可查證機制(MRV)機制為實踐NAMAs之正當程序的走向越趨明顯。各國配合國際的MRV標準的發展，積極建立國內法以實踐NAMAs內涵的程序規範，確保減緩行動之有效性，乃當前環境法研究中最迫切之議題。

本文將以台灣環境永續發展為基礎，著眼於正在發展中的國際「NAMAs的程序正義」以國際氣候變遷大會所建立的MRV方法論，檢視我國是否能夠透過MRV確保NAMAs的成效，同時亦能持續發展經濟；並且從比較法的角度來看，歐、美、日、韓等國的減緩策略皆以部門別區分為減緩之範圍，我國試圖以溫室氣體減量法來進行全國一致性的減緩措施，是否已經背於國際趨勢？且使用統一化之標準，是否會負面的增加國內產業在減緩上成本的負擔，導致產業的萎縮失去國際競爭力？

故此，分析我國在新公約體制下所形成的減緩架構，進而評估台灣內國法制是否能夠以MRV的確保相關產業和部會，落實部門減量、對外輔導產業善用新興的國際碳交易市場機制、對內強化法制建構，且積極進行教育宣導促進產業升級，達成我國NAMAs減緩目標。最後，筆者期望能藉由不同的研究視角，不在侷限於經濟或環境保護的兩分法，而是根據NAMAs之原則，以整合能源、產業和綠色科技的發展，透過積極參與國際NAMAs，逐漸改善我國長期在國際談判處於邊陲地位。
